You need to obtain Form 8379 and allocate income, adjustments, deductions and credits between yourself and your spouse in Part 2 of the form and send Form 8379 to the IRS, either with the joint return or separately after the joint return has been sent.

The IRS figures they shouldn't be sending you a refund when your husband owes them money.  Since you're married, you may have a refund on a joint return. It's likely that the IRS will try to seize that refund as your  spouse has an unpaid liability as described above. But if only one spouse, your hubby, in this case, owes the liability, the other spouse , you,are entitled to your share of the refund. If the IRS has applied your share of a refund against a liability owed by your hubby, you're an injured spouse entitled to relief. You can also use the injured spouse rule to prevent the IRS from grabbing your refund in the first place.If the IRS has applied your refund against your spouse's liability, or you're concerned that the IRS may do so, you need to obtain Form 8379 as you said.The form requests identifying information for you and your spouse, and information needed to determine how much of the tax  and refund  is attributable to each spouse. The IRS makes the actual calculation that divides the refund between you and your spouse. If you're an injured spouse for a return that's already been filed, you should file this form with the IRS Service Center for the place where you lived when you filed that return. If you're trying to prevent the IRS from seizing a refund on a return you haven't yet filed, you should attach Form 8379 when you file the return.

In almost all cases, this determination will come from an IRS notice, demand or collection action.Make sure you did not know your spouse was giving erroneous information when you signed the joint return. Occasionally you know nothing about the tax filings and find yourself responsible for the tax liability of the other spouse, your husband. Aside from filing a joint return, you must also prove that at the time you signed the tax return you did not know, and had no reason to know, that there was an understatement of tax .In this case, you may be able to claim innocent spouse relief by filing form 8857.  Intentional ignorance is not a good enough excuse. You basically need to have been deceived. Also you should determine that the understatement did not bring a significant benefit to you. The deception is not considered a significant benefit simply because your spouse supports you. But if your spouse was handling your investments and lied about them, you significantly benefited because your tax was understated.Obtain Form 8857. Fill it out and send it to the IRS.

For injured spouse relief, you need to verify that you filed a joint return with your spouse. And determine that the IRS has withheld or will withhold a tax refund because your spouse is past due on payments such as  federal or state debts.Then, you need to allocate income, adjustments, deductions and credits between yourself and your spouse in Part 2 of the form 8379 and send Form 8379 to the IRS, either with the joint return or separately after the joint return has been sent.

An innocent spouse can get relief when the other spouse makes false reports on a joint return. An injured spouse can get relief when the IRS withholds a joint refund due to debts or obligations of the other spouse.

You need to be able to find a venue to properly file your business taxes with if you happen to own a business. The venue can be very important to the taxpayer. You, as a taxpayer,  need to be able to properly file your return. You need to be careful when you are filing your own tax return, OK??? If you file the claim you will need to amend your tax return using Form 1040X and any other forms or schedules that would be different due to this change in filing status.Depending on your specific set of circumstances, the injured spouse allocation may or may not result in an additional refund amount. Also, it is important to remember that changing your tax return, also changes your spouse's tax return.
