이럴때는 어떻게 하나요?"----> I assume that you are legally divorced or separated; then in general, the custodial parent , you( a custodial parent is the person who has had primary custody of a child for most part the year claims the child for tax purposes.) can claim the child asyour dependent.if the court does not make any orders about the tax deduction, then the custodial parent automatically claims the child as a dependent for tax purposes. The IRS income tax rules say that the parent having custody for the greater portion of the calendar year receives the deduction. A court, can, however, order that the non-custodial parent , your ex-spouse, be allowed to claim the child for tax purposes. The court will order the custodial parent , you, to sign the proper IRS forms to allow the non-custodial parent , your ex,to claim the child for tax purposes. So, once you sign IRS Form 8332 , and provides it to your ex and if he attaches it to his return, then your exx can claim the child as his dependent. Often, the court will allow the non-custodial parent , your ex,to claim the child for tax purposes only if that parent is current on his or her child support payments.So, unless your ex receives the form 8332 from you, he can't claim the child as his dependent.
