>"아직 영주권이 없고 여기 살고 있지 않으면 jointly 로 못하는 건가요?
>Married filing separately 로 해야되나요?
>아님 그냥 single 이나 Head of household 로 해야 되나요?"--> As long as you are either US citizen or resident alien under either US tax Code or US INS rules, both you and your spouse inKorea can file your return as MFJ/MFS; it doesn't matter where your spouse is; since your spouse in Korea has no SSN, she can attach formW7 with your tax returnto get her itin.Filing your return as SINGLE is technically incorrect as you are married, however, if you file your as MFS, then the IRS doesn't care about your filing status( either MFS or single; there is no differenceof tax liaiblity beteen the single and MFS status). Asyou can see, the Married Filing Jointly filing status provides more tax benefits than filing separate returns, but you will need to weigh the pros and cons and decide for yoursselves which is the best filing status. You may file your retun as HOH as long as you have not lived with your spouse at any time during the last six months of the tax year.
++++++++++++++
I m not sure if you'd file your return as HOH, however, to file ur return as HOH, U need to meet the criteria required by the IRS. For instance, a qualifying person must live with you in the home for more than half the year; you should paiy more than half the cost of keeping up a home for the year; as you r married, you have not lived with your wife for more than six months of the tax year.
